BizFlowy Acceptable Use Policy
This Acceptable Use Policy (the “Policy”) sets out the rules applicable to your use of the BizFlowy Inc. (“BizFlowy”, “we”, “us” or “our”) Services and BizFlowy Technology, including via our Clients’ websites or platforms (the “Services”). The examples provided herein are not exhaustive.
This Policy should be read in conjunction with the BizFlowy Terms of Service (“BizFlowy Terms of Service”) (currently available at: https://legal.bizflowy.com/#termsofservice-us), into which it is incorporated by reference. We may suspend, terminate, or take other interim actions regarding your access to or use of the Services if, in our sole judgment, we believe you, directly or indirectly, have violated this Policy or have authorized or helped others to do so.
We may modify this Policy from time to time by posting a revised version on our Website. By using the Services, you agree to be bound by the latest version of this Policy. Any capitalized terms not defined in this Policy shall have the meanings provided in the BizFlowy Terms of Service.
General Policies and Requirements
We expect that the messages and communications sent and received will reach the intended recipients without being hindered by filtering or other blockers. To ensure this, you must prevent unwanted communications by only sending messages that comply with applicable laws and communications-industry guidelines and standards. Accordingly, all communications originating from your use of the BizFlowy Services and BizFlowy Technology (including, but not limited to, SMS, MMS, webchat, Voice, and similar messaging channels) are subject to, and must comply with, the BizFlowy Terms of Service and this Policy. This Policy sets out the following key requirements and prohibitions:
- Consent (“Opt-In”): Prior to sending the first message to an individual, you must obtain their explicit consent to communicate with them. Consent must be specific to the type of messages you intend to send. You must keep a record of this consent (e.g., a signed form or digital timestamp) as required by local regulations or best practices. If you do not send an initial message within a reasonable period after obtaining consent, you must reconfirm consent in your first message.
- Revocation of Consent (“Opt-Out”): Every initial message must include clear instructions for the recipient to opt out of receiving further communications. Standard opt-out language should be used (e.g., “Reply END to unsubscribe” or similar keywords such as STOP, STOPALL, UNSUBSCRIBE, or QUIT). Once an individual opts out, you may send one final confirmation message, after which no further messages may be sent without obtaining new consent.
- Sender Identification: Every message you send must clearly identify you as the sender—the party that obtained the opt-in from the recipient. This requirement applies to all messages, except follow-up messages within an ongoing conversation where the recipient’s initial message serves as both consent and proof of consent.
- Messaging Usage and Prohibited Content: All messages must comply with applicable laws and industry guidelines. You agree not to use the Services to send messages that contain, promote, or link to any information or content related to:
- Solicitations or Advertising: Unsolicited promotional messages or messages for which you do not have proper consent.
- Illegal, Harmful, or Fraudulent Activities: Content that facilitates or promotes activities such as child exploitation, fraudulent schemes, “get-rich-quick” schemes, high-risk financial services, unauthorized lead generation, debt collection scams, illegal substances, gambling, or any other activities deemed illegal or harmful.
- Infringing Content: Any material that infringes on intellectual property or proprietary rights.
- Offensive Content: Content that is harassing, defamatory, obscene, abusive, or invasive of privacy.
- Harmful Content: Content or technology (like viruses, Trojan horses, worms, time bombs, or cancelbots) that may damage or compromise systems, programs, or data.
- Evasive Content: Any content intentionally designed to evade detection by unwanted messaging filters, such as misspelled opt-out instructions or other non-standard language created to bypass monitoring systems.
- Prohibited Industries: If you use BizFlowy’s Payment Services, you may not send messages in connection with activities identified as prohibited under the BizFlowy Payment Service Terms.
- Message Abuse and Identity Falsification: You must not use automated systems (e.g., spam bots) to send messages, alter or obscure sender information, create false identities, or otherwise mislead recipients regarding the origin of the messages.
- Evasion Techniques: You are prohibited from using any means, such as “snowshoeing” (spreading identical messages across many numbers) or employing shared public URL shorteners, to evade our detection and prevention mechanisms.
- Solicitations or Advertising: Unsolicited promotional messages or messages for which you do not have proper consent.
- Scope of Use and Reasonable Use Limits: All Services (including Bulk Messages, Automations, bulk uploads, and the BizFlowy API) are subject to the Scope of Use limits specified in your Subscription Documentation or as detailed on our pricing page (e.g., https://www.bizflowy.com/pricing/). Excessive or abnormal usage beyond these limits may result in suspension or termination of your access to the Services.
Our Monitoring and Enforcement
BizFlowy reserves the right, though not the obligation, to monitor content transmitted via the Services to ensure compliance with this Policy and the BizFlowy Terms of Service. We may remove or disable access to any user, content, or resource that we determine, in our sole discretion, violates these rules. In addition, we may report any suspected violations of law to the appropriate law enforcement authorities or regulatory bodies, including by disclosing relevant customer information. We may also cooperate with law enforcement and regulatory agencies by providing necessary network and systems information related to alleged violations.

If you become aware of any violation of this Policy, please notify us immediately with details of the suspected breach. Your assistance may be requested to help remedy any violation.
